Welcome to BrewDrop. These Terms and Conditions govern your access to and use of our website, online store, products, services, content, checkout process, and any related communication with BrewDrop.
By visiting our website, placing an order, creating an account, subscribing to our emails, or purchasing from BrewDrop, you agree to these Terms and Conditions. If you do not agree, you should not use our website or purchase from us.
1. About BrewDrop
BrewDrop is an individual-owned e-commerce dropshipping business that sells coffee tools, coffee accessories, ground coffee, and related coffee products. Some products may be fulfilled, shipped, roasted, packaged, labeled, stored, processed, or delivered by third-party suppliers, manufacturers, roasters, fulfillment companies, shipping carriers, payment processors, Shopify, third-party applications, or other service providers.
BrewDrop acts as the online seller to the customer, but we may rely on third-party businesses to process payments, host the store, fulfill orders, manufacture products, package products, ship products, provide tracking information, provide analytics, provide marketing tools, or complete other business functions.
2. Use of Third-Party Platforms and Services
Our store may operate through Shopify and may use third-party payment processors, third-party suppliers, third-party fulfillment services, shipping carriers, marketing tools, analytics providers, review platforms, email platforms, and other business services.
By using our website or placing an order, you understand and agree that:
1. Third-party platforms and service providers may have their own terms, policies, privacy practices, refund rules, dispute procedures, limitations of liability, and legal requirements.
2. Your use of those third-party services may be governed by the terms and policies of those third parties.
3. BrewDrop does not control the internal policies, technology, business decisions, shipping systems, payment review systems, security practices, or legal terms of third-party companies.
4. To the maximum extent permitted by law, BrewDrop is not responsible for losses caused solely by the acts, omissions, delays, technical failures, policy decisions, legal violations, or service interruptions of third-party companies.
5. If a dispute, claim, chargeback, account limitation, payment hold, delivery issue, data request, or legal claim is caused by or directly relates to a third-party service provider, that issue may also be subject to the terms and dispute procedures of that third party.
Nothing in these Terms is intended to remove any consumer rights that cannot legally be waived.
3. Dropshipping Disclosure
BrewDrop is a dropshipping business. This means some or all products may be shipped directly from our suppliers, manufacturers, roasters, warehouses, fulfillment partners, or other third-party vendors.
Because we use third-party fulfillment partners:
1. Product packaging may vary.
2. Shipping times may vary.
3. Tracking information may come from third-party systems.
4. Products may ship in separate packages.
5. Products in the same order may arrive at different times.
6. Some items may become unavailable after checkout.
7. Supplier delays, carrier delays, customs delays, weather events, inventory errors, and address issues may affect delivery.
We make reasonable efforts to provide accurate product information, estimated delivery times, and order updates, but fulfillment depends partly on third-party providers.
4. Product Information
We try to display product names, descriptions, images, sizes, colors, materials, ingredients, roast details, prices, availability, and shipping information as accurately as possible. However, product details may occasionally contain mistakes, outdated information, supplier errors, image variations, typographical errors, or availability changes.
We reserve the right to correct errors, update product information, cancel orders, refuse orders, limit quantities, or change product offerings at any time, subject to applicable law.
Product images are for illustration and presentation purposes. Actual packaging, color, label design, size, shape, branding, or appearance may vary depending on supplier, manufacturer, roast batch, or fulfillment partner.
5. Coffee and Food Product Disclaimer
BrewDrop may sell ground coffee or related food products. Coffee products are intended for ordinary consumption by adults unless otherwise stated.
You agree that:
1. You are responsible for reviewing product labels, ingredients, allergen information, expiration dates, storage instructions, brewing instructions, and warnings before use.
2. You should not consume a product if the package appears damaged, opened, tampered with, contaminated, expired, or unsafe.
3. BrewDrop does not provide medical, nutritional, dietary, or health advice.
4. Statements about taste, aroma, roast level, brewing experience, energy, morning routine, or lifestyle are general marketing statements and are not medical claims.
5. BrewDrop products are not intended to diagnose, treat, cure, or prevent any disease or health condition.
6. If you have caffeine sensitivity, allergies, pregnancy-related restrictions, medical conditions, or dietary restrictions, consult a qualified professional before consuming coffee products.
6. No Health or Performance Guarantees
BrewDrop does not guarantee that any coffee, tool, accessory, brewing method, or product will produce a specific health result, energy level, productivity result, taste preference, weight-loss result, or performance outcome.
Any customer review, testimonial, social media post, or promotional statement reflects individual experience only and does not guarantee that you will have the same result.
7. Orders and Acceptance
Placing an order does not guarantee acceptance of the order. We may accept, reject, cancel, or limit an order for reasons including, but not limited to:
1. Product unavailability.
2. Supplier inventory errors.
3. Incorrect pricing.
4. Suspected fraud or unauthorized payment.
5. Incomplete or inaccurate shipping information.
6. Payment processor review or payment failure.
7. Shipping restrictions.
8. Legal or compliance concerns.
9. Abuse of discounts, promotions, or store policies.
If we cancel an order after payment has been collected, we will issue a refund according to our refund procedures and applicable law.
8. Pricing, Taxes, and Payment
Prices are listed in USD Dollars. Prices may change at any time without notice.
You are responsible for all applicable taxes, shipping charges, duties, import fees, processing fees, and other charges displayed at checkout or imposed by third parties.
Payments may be processed by third-party payment processors. BrewDrop does not control payment authorization decisions, fraud review decisions, bank holds, payment delays, processor outages, card network rules, or financial institution policies.
By placing an order, you represent that you are authorized to use the payment method provided.
9. Shipping and Delivery
Shipping times shown on our website are estimates only unless expressly stated as a guaranteed delivery date. Estimated delivery times may depend on supplier processing times, fulfillment location, shipping carrier performance, customs processing, customer location, weather, holidays, inventory availability, and other factors outside our control.
If we cannot ship an item within the advertised or promised time frame, we may contact you to request consent to a delay or provide a refund where required by law.
If no specific shipping time is stated, we will make reasonable efforts to ship within a reasonable time under applicable law.
BrewDrop is not responsible for delays caused by incorrect addresses, inaccessible delivery locations, customs inspections, carrier delays, failed delivery attempts, refused packages, natural disasters, strikes, government restrictions, or events outside our reasonable control.
10. Address Accuracy
You are responsible for providing a complete, accurate, and deliverable shipping address.
BrewDrop is not responsible for lost, delayed, returned, or misdelivered packages caused by incorrect, incomplete, outdated, or undeliverable address information provided by the customer.
If a package is returned because of an address error, you may be responsible for reshipping fees, supplier fees, carrier fees, or replacement costs, unless otherwise required by law.
11. Lost, Stolen, or Damaged Packages
If your package is lost, stolen, damaged, or marked as delivered but not received, contact us at jgiustiortiz@gmail.com as soon as possible.
We may ask for photos, order information, tracking information, packaging evidence, carrier claim information, or other documentation to review the issue.
Resolution may depend on the shipping carrier, supplier, fulfillment partner, insurance coverage, and applicable law. Depending on the case, we may offer a replacement, store credit, refund, or help with a carrier claim.
12. Returns and Refunds
Because BrewDrop may sell coffee and other consumable products, return eligibility may vary by product type.
Unless otherwise stated, the following rules apply:
1. Unopened, unused, non-food coffee tools and accessories may be eligible for return within 7 days after delivery.
2. Ground coffee, consumable goods, opened items, used items, final-sale items, personalized items, clearance items, and hygiene-sensitive items may not be returnable unless defective, damaged, incorrectly sent, or required by law.
3. To request a return, contact us at jgiustiortiz@gmail.com before sending any product back.
4. Returned items must be in original condition, with original packaging, accessories, manuals, and proof of purchase.
5. We may reject returns that are used, damaged by the customer, missing parts, opened, contaminated, altered, or sent without authorization.
6. Shipping fees may be non-refundable unless required by law or unless the return is due to our error.
7. Customers may be responsible for return shipping unless the item was defective, damaged, incorrect, or otherwise required by law.
8. Refunds may take several business days to appear depending on your bank, card issuer, payment processor, or payment method.
This Return and Refund section does not limit any rights you may have under applicable consumer protection law.
13. Cancellations
You may request order cancellation by contacting jgiustiortiz@gmail.com soon as possible after placing an order.
Because some orders are sent quickly to third-party suppliers or fulfillment partners, we cannot guarantee cancellation after an order is submitted. If the order has already been processed, fulfilled, shipped, roasted, packed, or transmitted to a supplier, it may no longer be cancelable.
14. Subscriptions, Recurring Orders, or Auto-Renewal
If BrewDrop offers subscriptions or recurring coffee drops, the subscription terms shown at checkout will apply.
By purchasing a subscription, you authorize recurring charges to your selected payment method until you cancel according to the cancellation instructions provided.
You are responsible for canceling before the renewal date if you do not want to be charged. Subscription changes, skipped orders, cancellations, and refunds may depend on the timing of the request and whether the order has already been processed.
15. Promotions and Discounts
Discounts, coupons, promotional codes, giveaways, bundles, and limited-time offers may be changed, limited, or discontinued at any time.
Promotions may not be combined unless expressly stated. We may cancel orders or promotions if we suspect fraud, misuse, technical errors, duplicate accounts, or abuse of promotional rules.
16. Third-Party Legal Terms and Disputes
Because BrewDrop uses third-party businesses to operate the store, the following may apply:
1. Shopify may have its own terms, privacy practices, acceptable use rules, and technical policies.
2. Payment processors may have their own dispute, refund, fraud review, chargeback, and account verification procedures.
3. Shipping carriers may have their own delivery rules, claims procedures, tracking systems, insurance limitations, and service guarantees.
4. Suppliers, roasters, manufacturers, and fulfillment partners may have their own production standards, warranty limitations, replacement procedures, return rules, and shipping policies.
5. Third-party apps, analytics tools, marketing platforms, and review platforms may have their own data policies and legal terms.
If your claim directly concerns the independent acts, omissions, systems, policies, or legal obligations of a third party, that claim may need to be handled under the third party’s terms, policies, dispute procedures, or legal process.
To the maximum extent permitted by law, BrewDrop is not liable for third-party conduct that is outside our reasonable control. However, this does not limit your rights against BrewDrop where applicable law makes BrewDrop responsible as the seller.
17. Chargebacks and Payment Disputes
If you have a problem with an order, contact us first at jgiustiortiz@gmail.com so we can try to resolve the issue.
Filing a false, abusive, or fraudulent chargeback may result in order cancellation, account restriction, refusal of future orders, collection of unpaid amounts, reporting to payment processors, or other lawful action.
We reserve the right to provide order records, tracking information, customer communications, delivery confirmations, IP address information, fraud analysis, and other relevant evidence to payment processors, banks, card networks, law enforcement, or legal authorities when responding to chargebacks, fraud claims, or legal disputes.
18. Accounts and Customer Responsibilities
If our website allows customer accounts, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.
You agree not to use our website for fraud, illegal activity, scraping, hacking, harassment, false orders, payment abuse, intellectual property violations, spam, malware, or interference with store operations.
We may suspend or terminate access to our website or refuse service if we believe you violated these Terms or applicable law.
19. Intellectual Property
All BrewDrop names, logos, designs, images, product descriptions, slogans, text, graphics, website content, branding, and related materials are owned by BrewDrop or licensed to BrewDrop unless otherwise stated.
You may not copy, reproduce, modify, sell, distribute, imitate, upload, scrape, or use our intellectual property without written permission.
Third-party trademarks, brand names, logos, product names, and service names belong to their respective owners.
20. Reviews, Photos, and User Content
If you submit reviews, photos, videos, comments, testimonials, messages, or other content to BrewDrop, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, edit, publish, and share that content for marketing, website, social media, customer service, and business purposes.
You represent that your content is truthful, lawful, and does not violate the rights of others.
We may remove or refuse user content that we believe is false, misleading, offensive, unlawful, defamatory, abusive, spam, or otherwise inappropriate.
21. Website Availability
We do not guarantee that our website will always be available, secure, error-free, uninterrupted, or free from technical issues. Website access may be affected by Shopify, hosting services, third-party apps, payment processors, internet service providers, maintenance, cyberattacks, software errors, or events outside our control.
22. Disclaimer of Warranties
To the maximum extent permitted by law, BrewDrop provides the website, products, and services “as is” and “as available.”
We do not make warranties that:
1. The website will be uninterrupted, secure, or error-free.
2. Product descriptions will always be completely accurate.
3. Products will meet your personal expectations or taste preferences.
4. Shipping will always occur within estimated time frames.
5. Third-party services will function without interruption.
6. Coffee tools will produce a specific brewing result.
Nothing in this section limits warranties, rights, or remedies that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent permitted by law, BrewDrop and its owner will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, lost business opportunities, emotional distress, reputational harm, or losses caused by third-party providers.
To the maximum extent permitted by law, BrewDrop’s total liability for any claim related to an order will not exceed the amount you paid for the product giving rise to the claim.
This limitation does not apply where prohibited by law, including liability that cannot legally be limited.
24. Indemnification
You agree to indemnify and hold harmless BrewDrop and its owner from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:
1. Your violation of these Terms.
2. Your misuse of the website or products.
3. Your violation of law.
4. Your violation of third-party rights.
5. Fraudulent orders, false claims, or abusive chargebacks.
6. Content you submit to BrewDrop.
25. Legal Compliance
You agree to comply with all applicable laws, including consumer protection laws, payment laws, tax laws, import/export laws, intellectual property laws, privacy laws, and food safety laws that apply to your use of our products and website.
BrewDrop reserves the right to cooperate with law enforcement, regulators, payment processors, shipping carriers, legal authorities, and third-party service providers when required or permitted by law.
26. Governing Law
These Terms are governed by the laws of Puerto Rico and applicable federal laws of the United States, without regard to conflict-of-law principles.
Nothing in these Terms limits any consumer rights or mandatory protections that apply in your jurisdiction.
27. Dispute Resolution
Before filing a legal claim, you agree to contact us at [jgiustiortiz@gmail.com](mailto:jgiustiortiz@gmail.com) and provide a reasonable opportunity to resolve the issue informally.
If the issue cannot be resolved informally, any dispute may be handled in the appropriate courts or legal forums permitted by applicable law.
BrewDrop reserves the right to seek immediate legal relief for fraud, intellectual property misuse, cyberattacks, payment abuse, unauthorized use of the website, or other urgent legal matters.
28. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our website with a new effective date.
Your continued use of the website after changes are posted means you accept the updated Terms.
